Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Masterypath website, applications, and related services (collectively, the "Service") provided by Masterypath Inc. ("Masterypath," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

I. Eligibility and Accounts

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is higher, to use the Service. You agree to provide accurate account information, including your handle, name, and email, and to keep that information current. You are responsible for activity under your account and for safeguarding your credentials. Notify us promptly of any unauthorized use.

II. Organizations and Permissions

The Service may allow you to create or join organizations and to invite members with different permission levels. If you administer an organization, you are responsible for managing member access, API keys issued for that organization, and content created within it. You represent that you have authority to bind your organization to these Terms when you act on its behalf.

III. Your Content

You retain ownership of content you submit or create in the Service, including topics, mindmaps, chat messages, flashcards, explanations, and related materials ("Your Content"). You grant Masterypath a worldwide, non-exclusive license to host, store, process, display, and transmit Your Content solely as needed to operate and improve the Service. You represent that you have the rights needed to submit Your Content and that it does not violate law or third-party rights.

IV. AI-Assisted Features

The Service may include AI-assisted tutoring, analysis, flashcard generation, and similar features. Outputs can be inaccurate, incomplete, or inappropriate for your situation. The Service is an educational tool and does not provide professional, medical, legal, financial, or other regulated advice. You are responsible for reviewing and verifying AI-generated content before relying on it.

V. Acceptable Use

You agree not to:

  1. Use the Service for unlawful, harmful, harassing, or fraudulent purposes;
  2. Attempt to access accounts, data, or systems you are not authorized to use;
  3. Reverse engineer, scrape, or overload the Service except as allowed by law;
  4. Upload malware or content that infringes intellectual property or privacy rights;
  5. Share API keys publicly or use them in a way that compromises account security;
  6. Interfere with other users' legitimate use of the Service.

VI. API Keys and Integrations

Organization administrators may create API keys for programmatic access. You are responsible for securing keys, rotating them when compromised, and for activity performed with keys issued to your organization. We may revoke keys that violate these Terms or threaten the Service.

VII. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if continued use would harm the Service or other users. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitation of liability.

VIII. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

IX. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MASTERYPATH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

X. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
